1. About IndianDeals
1. Indian Deals is a proprietorship operated by Syed Rizwan from the registered address stated in this document. The website indiandeals.com and associated mobile applications, features and services are collectively called the “Platform”.
2. The Platform enables independent users to create gadget advertisements, discover listings and communicate directly. IndianDeals does not ordinarily own, possess or sell user-listed products and is not a party to contracts concluded between users.
3. Contact and grievance email: support@indiandeals.com. No telephone support is offered unless IndianDeals expressly introduces it.
2. Acceptance and Eligibility
1. By accessing or using the Platform, creating an account, publishing a listing, contacting another user or purchasing an advertising service, you agree to these Terms and all linked policies.
2. You must be at least 18 years old and legally competent to enter a binding contract under Indian law. A person acting for a business confirms authority to bind that business.
3. You may not use the Platform if your account has been suspended or terminated, if applicable law prohibits your use, or if you provide false identity or registration information.
3. Accounts and Security
1. You must provide accurate, current and complete account information and keep it updated.
2. You are responsible for all activity through your account and for protecting passwords, OTPs and devices. IndianDeals will never ask for your UPI PIN, card PIN or banking password.
3. Notify IndianDeals promptly if you suspect unauthorised access. IndianDeals may require reverification, restrict features, reset credentials or temporarily suspend an account to protect users.
4. One person or business must not create multiple accounts to evade limits, moderation, suspension, featured-ad quotas or enforcement actions.
4. Nature of the Marketplace
1. IndianDeals provides technology that allows users to publish and discover third-party content. Sellers decide what to list, the price and whether to transact. Buyers independently decide whether to contact or transact.
2. IndianDeals does not inspect, test, verify, authenticate, certify, store, pack, deliver, repair, refurbish, insure or warrant user-listed goods unless a specific service is expressly described as an IndianDeals service.
3. IndianDeals does not act as broker, auctioneer, agent, trustee, escrow provider, payment intermediary for the underlying product sale, or guarantor of either party.
4. Any badges, moderation, account verification, automated checks or featured placement are limited platform signals and are not guarantees of identity, title, authenticity, condition, legality or trustworthiness.
5. Seller Obligations and Warranties
1. A seller must own the item or have valid legal authority from the owner to sell it.
2. The seller warrants that the item is not stolen, misappropriated, cloned, blacklisted, counterfeit, illegally obtained, unlawfully imported, subject to undisclosed finance, lien, hire-purchase, lease, employer ownership, insurance claim, police case or third-party right.
3. The seller must accurately disclose brand, model, storage/RAM/specifications, age, physical and functional condition, repaired or replaced parts, water or liquid damage, locks, account activation status, network restrictions, warranty status, missing accessories and all known defects.
4. Photos must show the actual item unless clearly labelled otherwise. Stock images must not create a misleading impression.
5. The seller must not manipulate IMEI/serial numbers, conceal activation locks, install unlawful software, or ask a buyer to participate in tax, customs, identity, payment or financing fraud.
6. The seller bears sole responsibility for the listing, communications, representations, collection of payment, delivery/hand-over, warranty promises, invoices, taxes and compliance with law.
6. Buyer Obligations and Assumption of Risk
1. Buyers must conduct their own due diligence and should inspect and test the item in a safe public place before payment.
2. Buyers should verify seller identity, ownership documents, original invoice where available, IMEI/serial number, blacklisting status, device locks, specifications, battery and hardware condition, accessories and repair history.
3. Buyers must independently evaluate price, quality, authenticity, legality and fitness for purpose. IndianDeals does not provide professional, technical or legal advice.
4. Buyers must not send deposits or advance payments merely because a listing appears urgent, featured or attractive. Featured status is advertising only.
5. Buyers and sellers are responsible for documenting their transaction, including receipts and agreed condition/warranty terms.
7. Prohibited Conduct
1. You must not use the Platform for unlawful, fraudulent, deceptive, abusive, harmful or infringing activity.
2. You must not scrape, copy, reverse engineer, overload, probe or interfere with the Platform; bypass security or rate limits; upload malware; automate messages without permission; impersonate others; harvest personal data; or use user information for unsolicited marketing.
3. You must not post fake enquiries, manipulate reviews or engagement, coordinate price manipulation, demand off-platform fees falsely described as IndianDeals fees, or send phishing links.
4. You must not discriminate unlawfully, threaten, harass, defame, sexually exploit, or publish another person’s sensitive or private information without lawful authority.
8. Listings and User Content
1. You retain ownership of content you submit, but grant IndianDeals a worldwide, non-exclusive, royalty-free licence to host, reproduce, adapt for formatting, translate, display, distribute and promote that content for operating and marketing the Platform.
2. You confirm that you own or have permission to use every image, logo, description and other material submitted.
3. IndianDeals may edit formatting, categorisation or obvious typographical elements; add safety notices; reduce image size; or use automated tools for moderation. IndianDeals is not required to pre-screen every listing.
4. IndianDeals may reject, hide, remove, restrict or retain evidence of any content at its discretion where it reasonably suspects policy violation, legal risk, fraud, poor quality, duplication or harm to users.
5. Deletion from public view may not immediately delete backup, security, billing, legal-compliance or evidentiary copies.
9. Communications and Direct Transactions
1. Users communicate and transact at their own risk. IndianDeals may provide messaging or contact tools but does not control statements made by users.
2. Product payments, deposits, refunds, warranties, returns, hand-over and delivery are directly between buyer and seller. IndianDeals provides no escrow and does not collect the purchase price for the listed gadget.
3. Users must comply with banking, UPI, tax and other applicable requirements. IndianDeals is not liable for a payment sent to the wrong person, chargeback, fake payment screenshot, cash dispute or account compromise.
4. IndianDeals may monitor or analyse communications to the extent permitted by law for safety, fraud prevention, support, moderation and service improvement, as explained in the Privacy Policy.
10. Featured Ads and Paid Advertising
1. IndianDeals may sell paid visibility such as featured, promoted, highlighted, boosted or priority placement. Payment purchases advertising services only and does not purchase the listed product.
2. Featured placement does not mean IndianDeals verified, endorsed, inspected or guaranteed the seller or item.
3. IndianDeals does not guarantee enquiries, views, leads, rankings, buyers, sales, revenue or any business result.
4. Placement, rotation, duration and display location may vary by device, category, geography, fraud controls, inventory and technical availability.
5. Prices, taxes and duration are shown before payment. Further terms appear in the Featured Ads and Refund Policy.
11. Suspension and Termination
1. IndianDeals may warn, restrict, suspend or terminate an account; limit contact features; remove listings; cancel promotional credits; or block devices and payment instruments where reasonably necessary for safety, legal compliance or enforcement.
2. Immediate action may be taken without prior notice for suspected stolen goods, fraud, counterfeit items, threats, repeat violations, law-enforcement requests, security incidents or risk to users.
3. You may stop using the Platform and request account deletion, subject to lawful retention of records.
4. Termination does not affect accrued rights, payment obligations, indemnities, disclaimers or clauses intended to survive.
12. Reports, Investigations and Law Enforcement
1. Users should report suspicious or unlawful listings using the report tool or support@indiandeals.com.
2. IndianDeals may request documents, identity verification, ownership proof, invoices, device identifiers or explanations. Failure to cooperate may lead to restriction or removal.
3. IndianDeals may preserve and disclose information when required or permitted by applicable law, valid legal process, government direction, police request, court order, fraud investigation, safety emergency or protection of rights.
4. IndianDeals does not promise to mediate, recover money, retrieve property, identify an anonymous user, or resolve private disputes.
13. Third-Party Services and Links
1. The Platform may use or link to maps, analytics, payment gateways, cloud providers, advertisements, social login, messaging or other third-party services. Their separate terms and privacy practices apply.
2. IndianDeals is not responsible for third-party availability, content, security, acts or omissions, except to the extent required by law.
14. No Warranties
1. The Platform is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, IndianDeals disclaims implied warranties of merchantability, fitness, non-infringement, accuracy, availability and uninterrupted or error-free operation.
2. IndianDeals makes no warranty about a user’s identity, ownership, authority, solvency, statements, product authenticity, title, legality, quality, safety, function, condition, specifications, value, delivery, warranty or after-sales conduct.
3. No advice, badge, moderation outcome, search rank, featured position, support response or platform communication creates a warranty unless expressly stated in a written agreement signed by IndianDeals.
15. Limitation of Liability
1. To the maximum extent permitted by applicable law, IndianDeals and the proprietor, employees, contractors and service providers will not be liable for indirect, incidental, special, exemplary, punitive or consequential loss; lost profits, business, opportunity, reputation, data or goodwill; or loss arising from a user transaction.
2. Without limiting the above, IndianDeals is not liable for stolen, counterfeit, cloned, blacklisted, defective, unsafe, damaged, misdescribed or illegally obtained goods; hidden defects; fraud; identity theft; phishing; payment disputes; non-delivery; personal meetings; warranty or return disputes; or acts and omissions of users.
3. Where liability cannot lawfully be excluded, IndianDeals’s aggregate liability arising from a paid advertising service will, to the extent permitted by law, be limited to the amount actually paid by the claimant to IndianDeals for that specific service during the three months preceding the event giving rise to the claim.
4. Nothing in these Terms excludes liability that cannot be excluded under applicable law, including liability arising from IndianDeals’s own fraud, wilful misconduct or a mandatory statutory obligation.
16. Indemnity
1. You agree, to the extent permitted by law, to defend, indemnify and hold harmless Indian Deals, Syed Rizwan and their personnel and service providers from claims, proceedings, losses, penalties, damages, liabilities and reasonable legal costs arising from your content, listing, product, transaction, breach of these Terms, violation of law, infringement of rights, fraud, tax obligation or misuse of the Platform.
2. IndianDeals may control the defence or settlement of a claim affecting it. You must reasonably cooperate and must not settle a claim imposing liability or admission on IndianDeals without written consent.
17. Privacy
1. Personal data is processed according to the Privacy Policy and applicable law. By using the Platform, you acknowledge that data may be processed by service providers and across locations necessary to operate the service, subject to applicable safeguards.
2. Do not upload Aadhaar numbers, banking passwords, card PINs, UPI PINs or unnecessary identity documents into public listings or chats.
18. Changes to the Platform and Terms
1. IndianDeals may modify, discontinue or introduce features and may update these Terms. The effective date will be shown.
2. Material changes will be notified through the Platform, email or another reasonable method. Fresh consent may be requested where required. Continued use after a non-material update constitutes acceptance to the extent permitted by law.
19. Governing Law and Disputes
1. These Terms are governed by the laws of India.
2. Users should first send a written complaint to support@indiandeals.com and allow a reasonable opportunity for resolution.
3. Subject to mandatory consumer or other statutory rights, courts at Bangalore, Karnataka will have exclusive jurisdiction.
20. General Terms
1. If any provision is held invalid, the remaining provisions continue in effect and the invalid provision will be enforced to the maximum lawful extent.
2. Failure to enforce a provision is not a waiver. You may not assign your rights without consent; IndianDeals may assign or transfer the Platform as part of restructuring or sale, subject to law.
3. These Terms and incorporated policies form the entire agreement concerning use of the Platform, except for a separate written commercial agreement.
4. Headings are for convenience. Words such as “including” are illustrative and not limiting.
